COPPA Law

Rate this Entry
A lot of you seem to have to idea that COPPA forbids users from under 13 years old from being on fora at all. This, however, is not the case.

COPPA forbids children who are less than thirteen years old from signing up for a site without permission from their parents. However, just a tick of "I am 13 years or older or have permission from my parents" does not live up to COPPA, since it requires a reasonable way to check.

What does this mean? Simple, if Jiggmin adds a system to get the parents' permission (For instance sending the parents an E-Mail to confirm their children joining JV) people who are 12- years old CAN be on JV without violating COPPA

She still got banned because the thread on JV was about banning all users under 13 years old, which is excessive.

Then maybe we should have a system that automatically sends a mail to the parents' e-mail adress? It would prevent a lot of hassle.

    It wouldn't work.
anyone could make a new email and say it's their parents

The point is that you've fulfilled the reasonable check for COPPA at that moment.

Honestly, I'd rather see this website go down if the forum gets caught having *cue gasp* uncertified youngsters (which is a risk that is ludicrously ambiguous), rather than this unofficial rule that allows our moderation staff to relentlessly crack down users for something that doesn't even threaten the forum and give them some kind of pang of guilt even though their innocence is total.

But some people (like me) put in their own email, not their parent's. So....

    idk ok

By "mail" I meant printed mail, Chimpy.

And well... Jiggmin would have to handle the parental permission himself, because the law requires him to do so. If he receives sufficient proof of parental permission he'll probably unban the users.
