I know, I am not a lawyer. But I just want reasons of why exactly the Grandfather Clause would not apply to current underage users?
The grandfather clause isn't a law...it's just an option when sorting out a disagreement. clause: a distinct article or provision in a contract, treaty, will, or other formal or legal written document. A grandfather clause might have been worked out. But that's just not the way it happened.

I know it's not a law lol It's simply a clause that allows an exception to individuals whom were 'breaking' the law, but can't be punished because the new law only applies to future law-breakers.
But the law was around before they even signed up on the forum, it's just that it wasn't enforced as a rule until recently.
If I understand correctly you're asking whether users who signed up under 13 on JV, and are still under 13, should be banned under new enforcement of coppa? I'm not sure about coppa's ins and outs, but I think the answer's yes, they would still be bannable, because coppa existed before these members signed up. However coppa's- on the face of it-a poorly composed piece of trash, because there isn't a practical way to enforce it and it portrays a naive understanding of the web. The people who really can regulate their child are the legal guardians- mods at JV have little to no way of confirming whether someone is over 13 or if the parents are complicit, so it's like asking them to prove negatives, which is pointless.
